Welcome to Zerxus. These Terms of Service (“Terms”) govern your access to and use of the Zerxus application and website (the “Service”), operated from Ontario, Canada. By using the Service, you agree to these Terms. If you do not agree, please do not use the Service.
1. What Zerxus is
Zerxus is a software tool that uses artificial intelligence to generate personalized exercise programs, provide training suggestions, and let you log and track workouts. Zerxus is a fitness software product, not a medical service.
2. Not medical advice
Zerxus does not provide medical advice, diagnosis, or treatment. The programs, suggestions, and information provided are for general fitness and informational purposes only. Exercise carries inherent risks. You should consult a qualified physician or healthcare provider before beginning any exercise program, especially if you have any injury, medical condition, are pregnant, or have concerns about your health. You use the Service and perform any exercise entirely at your own risk.
3. Eligibility
You must be at least 18 years old, or the age of majority in your jurisdiction, to create an account and use the Service.
4. Accounts and access
Access to Zerxus requires a paid subscription. After payment, an account is activated for you and you receive a secure sign-in link by email. You are responsible for keeping your account access secure and for all activity under your account. You agree to provide accurate information.
5. Subscriptions, billing, and cancellation
- Zerxus is offered on a monthly or annual subscription, billed in advance through our payment processor (Stripe).
- Subscriptions renew automatically at the end of each billing period unless cancelled.
- You may cancel at any time; your access continues until the end of the current paid period.
- Except where required by law, payments are non-refundable. We may, at our discretion, offer refunds in individual cases.
- Prices may change; we will give reasonable notice before any change affects your renewal.
6. Acceptable use
You agree not to misuse the Service, including attempting to access it through unauthorized means, reselling or sharing your account, reverse-engineering the Service, or using it to violate any law. We may suspend or terminate accounts that violate these Terms.
7. AI-generated content
Programs and coaching responses are generated by artificial intelligence and may contain errors or may not be suitable for your specific circumstances. Use your own judgment, and stop any exercise that causes pain or discomfort. We do not guarantee any specific fitness results.
8. Intellectual property
The Service, including its design, code, and branding, is owned by Zerxus and protected by applicable laws. Your workout data and logs belong to you; you grant us a limited license to process them solely to provide and improve the Service.
9. Limitation of liability
To the maximum extent permitted by law, Zerxus and its operator are not liable for any injury, loss, or damage arising from your use of the Service, including from following any program or suggestion. The Service is provided “as is” without warranties of any kind. Our total liability for any claim is limited to the amount you paid in the twelve months before the claim.
10. Changes to these Terms
We may update these Terms from time to time. Material changes will be communicated through the Service or by email. Continued use after changes means you accept the updated Terms.
11. Governing law
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein.
